Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Next Saviours mobile application and related services (collectively, the "App") provided by NextSaviours Education Private Limited ("we", "us", or "our").

By downloading, installing, or using the App, you agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree, do not use the App.

1. Eligibility

You must be at least 18 years of age to use the App. By using the App, you represent and warrant that:

  • You are at least 18 years old;
  • You have the legal capacity to enter into a binding agreement;
  • You will use the App only for lawful purposes and in accordance with these Terms.

The App is designed for medical students and healthcare professionals preparing for postgraduate entrance examinations, including NEET PG, INI-CET, and FMGE. Use outside this intended audience is at your own discretion.

2. Account Registration

2.1 Creating an Account

You may register using Google Sign-In, Apple Sign-In, or an email address and password. You agree to provide accurate, current, and complete information during registration and to update it to keep it accurate.

2.2 Account Security

You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Notify us immediately at support@nextsaviours.com if you suspect unauthorised access to your account. We are not liable for any loss or damage arising from your failure to keep your credentials secure.

2.3 One Account Per User

You may create only one account per person. Creating multiple accounts to circumvent usage limits or subscription restrictions is prohibited and may result in termination of all associated accounts.

3. Subscription Plans and Payments

3.1 Free and Paid Tiers

The App offers both a free tier and paid subscription plans. Paid plans provide access to additional features including higher daily question limits, increased AI chat messages, and access to advanced learning stages (Core Knowledge, Clinical, and INI-CET levels).

3.2 Billing

  • iOS: Subscriptions are billed through Apple's App Store. Payment is charged to your Apple ID at confirmation of purchase. Your subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period. You can manage or cancel your subscription in your Apple ID Account Settings.
  • Android: Subscriptions may be billed through Google Play or directly via Razorpay. Razorpay processes payments in accordance with its own terms and privacy policy.

3.3 Pricing

Current pricing for subscription plans is displayed within the App prior to purchase. We reserve the right to change pricing at any time with reasonable prior notice.

3.4 Refunds

  • iOS: All purchases made through the App Store are subject to Apple's refund policy. Refund requests must be submitted to Apple.
  • Android / Razorpay: Refund requests may be submitted to us at support@nextsaviours.com within 7 days of purchase. Refunds are issued at our discretion except where required by applicable law.

3.5 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period, and you will retain access to paid features until that date. We do not provide prorated refunds for unused subscription time except where required by law.

4. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose or in violation of any applicable laws or regulations;
  • Share, sell, or transfer your account credentials or subscription access to any other person;
  • Attempt to reverse-engineer, decompile, disassemble, or otherwise derive source code from the App;
  • Use automated tools (bots, scrapers, or similar) to access, extract, or interact with any part of the App;
  • Attempt to circumvent subscription paywalls, usage limits, or access controls;
  • Submit false, misleading, or offensive content through the AI chat feature;
  • Interfere with or disrupt the App's servers or networks;
  • Impersonate any person or entity or falsely represent your affiliation with any person or entity;
  • Upload content that contains malware, viruses, or any code designed to harm or disrupt systems.

5. Intellectual Property

5.1 Our Intellectual Property

The App, including its design, user interface, branding, educational content, AI-generated questions, and underlying technology, is owned by NextSaviours Education Private Limited or its licensors and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable licence to use the App for your personal, non-commercial educational purposes, subject to these Terms.

5.2 Your Content

You retain ownership of any content you submit through the App (such as profile information or chat messages). By submitting content, you grant us a worldwide, royalty-free, non-exclusive licence to use, store, and process that content solely to provide and improve the App's services. You represent that you have all rights necessary to grant this licence.

5.3 AI-Generated Content

Quiz questions, explanations, hints, and AI chat responses generated by the App are produced using artificial intelligence and are provided for educational purposes only. Ownership of AI-generated content remains with NextSaviours Education Private Limited to the extent permitted by law.

6. Medical and Educational Disclaimer

IMPORTANT — PLEASE READ CAREFULLY.

The App provides educational content designed to assist medical students in preparing for entrance examinations such as NEET PG, INI-CET, and FMGE. The content within the App — including AI-generated questions, explanations, clinical scenarios, and chat responses — is for exam preparation and educational purposes only.

  • The App is not a medical device and is not intended to provide medical advice, diagnosis, or treatment for any patient or clinical situation.
  • AI-generated content may contain inaccuracies, outdated information, or errors. Always verify clinical information against authoritative medical literature, textbooks, and institutional guidelines.
  • Nothing in the App creates a doctor-patient relationship or constitutes professional medical advice.
  • Do not rely on the App's content when making clinical decisions for real patients.

We disclaim all responsibility for any clinical decision made on the basis of content accessed through the App.

7. AI Chat Feature

The Astra AI Mentor is an AI-powered chat assistant powered by large language model technology. By using this feature, you acknowledge:

  • AI responses are generated automatically and may not always be accurate, complete, or current;
  • Your chat messages are transmitted to our AI processing infrastructure (including OpenAI's API) for response generation;
  • You should not share personally identifiable patient information, confidential information, or sensitive personal data in the chat;
  • We reserve the right to review chat logs for safety, abuse prevention, and service improvement purposes, subject to our Privacy Policy.

8. Availability and Service Changes

We strive to maintain continuous availability of the App but do not guarantee uninterrupted access. We reserve the right to:

  • Modify, suspend, or discontinue any part of the App at any time with reasonable notice where practicable;
  • Update, change, or remove features, content, or subscription tiers;
  • Conduct maintenance that may result in temporary downtime.

We are not liable for any loss or inconvenience caused by App unavailability.

9. Account Termination

9.1 Termination by You

You may delete your account at any time through the App's Profile settings. Deletion is subject to the data retention provisions in our Privacy Policy.

9.2 Termination by Us

We may suspend or terminate your account with immediate effect if we determine, in our sole discretion, that you have violated these Terms, engaged in fraudulent activity, or your continued use poses a risk to other users or the App's integrity. We will provide notice where legally required or reasonably practicable.

9.3 Effect of Termination

Upon termination, your right to use the App ceases immediately. Provisions of these Terms that by their nature should survive termination — including intellectual property rights, disclaimers, limitation of liability, and dispute resolution — will survive.

10. Disclaimers of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE, UNINTERRUPTED, SECURE, OR THAT DEFECTS WILL BE CORRECTED.

AI-GENERATED CONTENT IS PROVIDED WITHOUT ANY WARRANTY OF ACCURACY OR COMPLETENESS. WE DO NOT WARRANT THAT THE EDUCATIONAL CONTENT WILL ENSURE SUCCESS IN ANY EXAMINATION.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NEXTSAVIOURS EDUCATION PRIVATE LIMITED AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF DATA, LOSS OF PROFIT, OR EXAMINATION FAILURE — ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR INR 500 / USD 10, WHICHEVER IS GREATER.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

12. Indemnification

You agree to indemnify, defend, and hold harmless NextSaviours Education Private Limited and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or relating to: (a) your use of or access to the App; (b) your violation of these Terms; (c) your violation of any third-party right; or (d) any content you submit through the App.

13. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Any dispute, claim, or controversy arising out of or relating to these Terms or the App shall first be attempted to be resolved through good-faith negotiation between the parties. If negotiation fails, the dispute shall be submitted to binding arbitration in accordance with the Arbitration and Conciliation Act, 1996, with the seat of arbitration in Moradabad, UP, India.

Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction.

14. Third-Party Services

The App integrates with third-party services including Google, Apple, AWS, OpenAI, and Razorpay. Your use of those services is governed by their respective terms and privacy policies. We are not responsible for the practices or content of any third-party service.

15. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last Updated" date at the top and provide notice within the App or by email. Your continued use of the App after the effective date of the updated Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the App and delete your account.

16. General Provisions

  • Entire Agreement: These Terms and the Privacy Policy constitute the entire agreement between you and NextSaviours Education Private Limited regarding the App and supersede all prior agreements.
  • Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
  • No Waiver: Our failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce it in the future.
  • Assignment: You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights without restriction.
  • Language: These Terms are provided in English. In case of any conflict between an English version and a translated version, the English version prevails.
